The class is distinguished from legitimate persuasion (transparent nudges, ethical design) by its deceptive character: the pattern conceals its true purpose, exploits cognitive vulnerabilities rather than informing decisions, and produces outcomes contrary to what the user would choose with full information and undistracted deliberation. The concept emerged from UX research in the 2000s (Brignull, 2010) and has since been recognized by regulators (EU DSA, California Consumer Privacy Act) as a form of manipulative design.
